19.13.2 Definitions

The following definitions shall apply in connection with this Policy:

Accessibility Coordinator means the individual that is designated from time to time to oversee and coordinate all aspects of this Policy and the University’s digital accessibility efforts.

Accessible means that a person with a disability is afforded the opportunity to acquire the same information, engage in the same interactions, and enjoy the same services as a person without a disability in an equally effective manner, with substantially equivalent ease of use. Although accessibility might not result in identical ease of use compared to that of persons without disabilities, it still ensures equal opportunity to the educational benefits and opportunities afforded by the technology and equal treatment in the use of such technology. As applied to a University Website discussed under Section 19.13.3 of this Policy, “Accessible” means conformance with Web Content Accessibility Guidelines (WCAG) 2.0 Level AA success criteria (WCAG 2.1 Level AA success criteria as of December 31, 2020), except where specifically modified through an exemption pursuant to this Policy. As applied to software and hardware systems under Section 19.13.7 of this Policy, “Accessible” means compatible with mainstream assistive technology. Without limitation of the foregoing, the University may adopt specific accessibility standards from time to time, which once adopted and until superseded, shall be fully incorporated into and shall be a part of this Policy.

Disability means a physical or mental impairment that substantially limits one or more major life activities as defined in the Americans with Disabilities Act (as amended) and Section 504 of the Rehabilitation Act of 1973 (as amended).

Electronic Media means video, audio, fax, CD-ROMs, DVDs, and any other non-print medium that requires electricity or digital encoding of information.

Equally Effective Alternative Access to digital content for persons with Disabilities is based on (1) timeliness of delivery, (2) accuracy of translation, and (3) delivery in a manner and medium appropriate to the Disability of the person. Such alternative access, while equally effective, is not required to produce the identical result or level of achievement for disabled and non-disabled persons but must afford disabled persons equal opportunity to obtain the same result, to gain the same benefit, or to reach the same level of achievement, in the most integrated setting appropriate to the person’s needs.

Full and Equal Access means, in relation to a University Website, that the website conforms to the requirements of WCAG 2.0, Level AA success criteria (WCAG 2.1 Level AA success criteria as of December 31, 2020) and those guests using screen-reader software may acquire the same information and engage in the same transactions as are available to other guests with substantially equivalent ease of use.

Fundamental Alteration means a change to a University Program that alters the essential purpose of the Program or any of its components. In situations where a Fundamental Alteration is documented, Equally Effective Alternate Access will still be provided.

Information Technology includes any system or component part thereof, including any application or service that is delivered via the web that is employed in connection with a University Program to create or use electronic data or information.

Instructional Materials means any syllabi, textbooks, presentations, handouts, and other materials used with students for instruction, however delivered, that are required for participation in and completion of a University Program.

Undue Financial and Administrative Burdens are created when a proposed course of action causes significant difficulty or expense, considering the University’s available resources. In situations where an Undue Financial and Administrative Burden is documented, Equally Effective Alternate Access will still be provided.

University Personnel means any member of the University’s faculty or staff, including a student employee, intern, or volunteer.

University Program means any University course, degree program, service, or official activity.

University Website means the University’s website located at fnu.edu, the online course platform(s) used for University Programs, and any other website that is owned, operated, and maintained by the University and which is used in connection with a University Program.
